These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PlayStrux regarding your access to and use of the Site, including all content, features, and services offered through the Site (collectively, the "Services"). By accessing the Site or using any Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. 2. Acceptance of Terms

As a game development studio focused on PC games, we design the Site to be accessible and engaging for users worldwide. 3. Intellectual Property

The Site and all content thereon, including but not limited to text, graphics, logos, images, videos, audio files, software, downloadable materials, and any other materials related to our PC games and indie games (collectively, "Content"), are owned by PlayStrux or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws under Spanish and international law.

PlayStrux, the PlayStrux logo, and all titles, characters, and elements from our immersive gaming worlds are trademarks of PlayStrux S.L. All rights reserved. No Content may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means, including but not limited to electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of PlayStrux, except as permitted by applicable law.

Subject to your compliance with these Terms, PlayStrux grants you a limited, revocable, non-exclusive, non-sublicensable, non-transferable license to access and use the Site and Content for your personal, non-commercial use only. This license does not permit you to modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Site or Content.

As a game development studio, much of our Content, such as game trailers, screenshots, and concept art, is proprietary and represents years of creative effort in developing innovative gameplay and immersive narratives for PC games. Unauthorized use of this Content may result in legal action, including claims for copyright infringement.

If you believe that your intellectual property rights have been violated on the Site, please contact us immediately at contact@playstrux.com with details of the alleged infringement. We will respond promptly in accordance with applicable laws, such as the EU Digital Services Act.

User-generated content submitted through community features is subject to these Terms and may be used by PlayStrux for promotional purposes related to our indie games, with attribution where appropriate.

4. User Conduct

You agree to use the Site and Services in a manner that is lawful, ethical, and respectful. Prohibited uses include, but are not limited to:

• Posting, uploading, or transmitting any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
• Interfering with or disrupting the Site, including by introducing viruses, malware, or using automated tools to scrape content;
• Impersonating any person or entity, including PlayStrux employees or community members;
• Engaging in commercial activities without permission, such as advertising or soliciting;
• Violating the privacy or publicity rights of others;
• Attempting to gain unauthorized access to any part of the Site or our systems.

In our community hub, designed for fans of PC games and immersive gaming, we promote positive interactions. Violations of these conduct rules may result in content removal, account suspension, or reporting to authorities if necessary.

PlayStrux, as an innovative game development studio, moderates community content to ensure it aligns with our values of creativity and respect. By participating, you grant us a perpetual, royalty-free license to use, modify, and distribute your submissions in connection with the Site and our indie games.

You are solely responsible for your interactions with other users and any content you post. PlayStrux disclaims all liability arising from user interactions.

5. Disclaimer of Warranties and Limitation of Liability

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of title, merchantability, fitness for a particular purpose, non-infringement, or that the Site will be error-free, secure, or uninterrupted.

PlayStrux does not warrant that the Content is accurate, complete, reliable, or current, nor that the Site will meet your specific requirements. Use of the Site is at your own risk. As a game development studio, we aim to provide high-quality information about our PC games, but we cannot guarantee outcomes related to downloads or community interactions.

To the fullest extent permitted by law, PlayStrux, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the Site, even if advised of the possibility of such damages.

Our total liability for any claim under these Terms shall not exceed €100. This limitation applies to all claims, whether in contract, tort, or otherwise.

Nothing in these Terms excludes or limits liability for death, personal injury, fraud, or any other liability that cannot be excluded by law.

Indemnification: You agree to indemnify and hold harmless PlayStrux from any claims, losses, or damages arising from your violation of these Terms or your use of the Site.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Spain, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts located in Madrid, Spain.

You agree that any legal action or proceeding relating to the Site must be brought within one (1) year after the claim arises, or it will be permanently barred.
